Retail Reps Hit Crossmark With Overtime Action

Law360, New York (February 10, 2011, 1:57 PM EST) -- A nationwide group of retail representatives have filed a putative class action against marketing company Crossmark Inc., alleging it violated the Fair Labor Standards Act when it required them to work overtime without additional pay.

The complaint, filed Wednesday in the U.S. District Court for the Eastern District of Pennsylvania, said Crossmark "engaged in a company-wide, widespread pattern and practice of FLSA violations and intentional schemes designed to undermine and avoid the wage and overtime provisions of the FLSA."
