Fed. Circ. Sends Bluetooth Patent Suit To Texas

Law360, New York (February 9, 2011, 8:11 PM EST) -- The Federal Circuit on Wednesday rejected an attempt by Aliphcom to keep its lawsuit, which seeks a declaration that two Wi-LAN Inc. patents covering Bluetooth technology are invalid, in California rather than Texas.

In denying Aliphcom's petition for a writ of mandamus, a three-judge panel of the U.S. Court of Appeals for the Federal Circuit said the lower court did not clearly and indisputably abuse its discretion by ordering the transfer of the declaratory judgment action.
