Judge Pares Enviro Claims Against Bridgestone, Others

Law360, New York (February 10, 2011, 4:08 PM ET) -- A federal judge narrowed an environmental waste cleanup suit against Bridgestone Americas Tire Operations LLC and others Thursday, citing case law barring plaintiffs from claiming unjust enrichment on obligatory remedial costs.

Plaintiffs Hobart Corp., Kelsey-Hayes Co. and NCR Corp. cannot recover under an Ohio unjust enrichment claim because the averred losses — cleanup costs for the South Dayton Dump and Landfill — were due under a legally binding settlement, according to Judge Walter Herbert Rice of the U.S. District Court for the Southern District of Ohio....
