Law360, New York (February 14, 2011, 2:21 PM ET) -- A federal judge has determined that Navigators Insurance Co. is entitled to recoup amounts it paid in the defense and settlement of an underlying malpractice suit brought against Arizona law firm Phillips & Associates PC.
Judge David G. Campbell of the U.S. District Court for the District of Arizona on Friday granted the insurer's motion for partial judgment on its counterclaim for a declaration that it is entitled to recover amounts paid under a professional liability policy, while rejecting plaintiff Phillips' motion for partial summary judgment....
