Medical Insurer Loses Defense Coverage Bid

Law360, New York (February 16, 2011, 5:38 PM EST) -- A California appeals court has remanded a decision awarding summary judgment to American International Specialty Lines Insurance Co. in a dispute over whether it should cover litigation costs for medical malpractice carrier The Doctors Co.

The California Court of Appeal’s First Appellate District on Monday reversed the ruling and remanded the case to trial court, finding that AISLIC was not entitled to summary judgment on TDC's claims of breach of contract and breach of implied covenant of good faith and fair dealing.
