Judge Tosses NML Suit Against Energia Argentina

Law360, New York (February 16, 2011, 6:22 PM EST) -- A federal judge has dismissed a suit brought by investment bank NML Capital Ltd. against energy company Energia Argentina SA that sought to hold it liable for $1.5 billion bond debts on which the Argentine government defaulted in 2001.

In an opinion issued Tuesday, Judge Thomas Griesa of the U.S. District Court for the Southern District of New York concluded that NML had not shown Enarsa was an alter ego of Argentina's government and dismissed the complaint for lack of personal and subject-matter jurisdiction and failure...
