Fed. Circ. Revives ABB Declaratory Judgment Case

Law360, New York (February 17, 2011, 3:24 PM EST) -- The Federal Circuit on Thursday reversed the dismissal of ABB Inc.'s suit against Cooper Industries LLC seeking a judgment that it does not infringe several patents related to electrical equipment and insulation fluid.

A three-judge panel in the U.S. Court of Appeals for the Federal Circuit ruled that ABB’s declaratory judgment action did in fact arise under the patent laws, and that jurisdiction was conferred.
