High Court Denies Appeal Of Exide Trademark Ruling

Law360, New York (February 22, 2011, 8:07 PM EST) -- The U.S. Supreme Court on Tuesday refused to hear Exide Technologies' challenge to a ruling that its bankruptcy did not nullify a trademark agreement it made with EnerSys Delaware Inc. in a $135 million deal for its industrial battery business.

Exide had attempted to bring its case to the Supreme Court after the U.S. Court of Appeals for the Third Circuit in June reversed rulings from federal bankruptcy and trial courts in Delaware that allowed Exide to reject its trademark licensing deal with EnerSys.
