Supreme Court Won't Hear Calif. Critical Habitat Suit

Law360, New York (February 22, 2011, 7:28 PM EST) -- The U.S. Supreme Court on Tuesday denied a request by the Building Industry Association of the Bay Area to review an appeals court decision affirming the designation of 850,000 acres as critical habitat for 15 protected vernal pool species.

In a victory for the U.S. Fish and Wildlife Service and several conservation groups, the high court denied BIA Bay Area's petition for writ of certiorari without giving a reason for its decision.
