Jury Awards Ex-BNSF Engineer $1.9M For Injuries

Law360, New York (February 23, 2011, 6:54 PM EST) -- A Texas jury on Friday awarded $1.9 million to a former BNSF Railway Co. locomotive engineer after finding that the railroad failed to properly maintain its seats and other structures that contributed to the engineer’s back and neck injuries.

Following a four-week trial, the jury in the 236th Judicial District Court of Tarrant County determined that Fort Worth-based BNSF violated federal laws and regulations, and that its negligence caused the injuries suffered by James Phillips, according to Fred Bremseth of Bremseth Law Firm, who represented Phillips....
