Law360, New York (April 06, 2011, 6:16 PM ET) -- The Texas Supreme Court has spurred litigation with rulings that emboldened employers to enforce noncompete pacts. It now has the chance to issue another enforcement-friendly ruling in a pending case brought by Marsh USA Inc. challenging a finding over the insurer's nonsolicitation pact with an ex-employee, but lawyers say that decision could mean less litigation, not more.
