ITC To Revisit Samsung Capacitor Decision

Law360, New York (February 24, 2011, 2:53 PM EST) -- The U.S. International Trade Commission agreed Wednesday to review a portion of an administrative law judge's decision that Samsung Electro-Mechanics Co. Ltd.'s importation of certain capacitors does not violate three patents belonging to a Japanese rival.

The ITC instituted a Section 337 investigation into the matter in November 2009 after Murata Manufacturing Co. complained Samsung was infringing its patents. In December, Judge E. James Gildea issued an initial determination finding the patents were not infringed.
