Law360, New York (April 15, 2011, 4:36 PM ET) -- Judge Leonard Davis of the U.S. District Court for the Eastern District of Texas has begun trying to prevent cost-of-litigation settlements in patent cases with many defendants, setting forth case management standards and potential punishments that other judges may follow.
In a series of orders over the past couple of months, Judge Davis has said he would consider sanctions whenever it appeared that the cost of a case was more of a driving force than the merits of a patent-in-suit.
