Judge Backs State Regulators In Miss. Coal Plant Suit

Law360, New York (March 1, 2011, 7:55 PM EST) -- The Sierra Club lost a bid Monday to block Southern Co. subsidiary Mississippi Power Co. from building a coal-fired power plant in eastern Mississippi when a judge ruled that state regulators committed no error in approving the project.

Judge Jim Persons of the Chancery Court of Harrison County rejected the environmental group's argument that the Mississippi Public Service Commission arbitrarily and capriciously approved the Kemper County project.
