Mo. Labor Department Wins Contractor Wage Dispute

Law360, New York (March 2, 2011, 5:44 PM EST) -- Missouri's top court Tuesday said government contractors must pay prevailing wages to workers performing major repairs on public utilities, ruling such work was considered construction and not maintenance under the state's labor laws.

The decision written by Judge Mary R. Russell of the Supreme Court of the State of Missouri said that because the workers were performing major repairs at a water tower in Monroe City, Mo., including the replacement of steel parts and expansion joints, they were performing construction rather than mere maintenance as employer...
