4th Circ. Says Food Co. Must Face Gay Bias Trial

Law360, New York (March 4, 2011, 12:29 PM EST) -- The Fourth Circuit said Thursday that a South Carolina food service company that contracted with a hospital could be liable for failing to protect an employee who was subjected to anti-gay slurs from hospital staff, remanding the case for trial.

The unpublished ruling by the U.S. Court of Appeals for the Fourth Circuit reverses a decision by the U.S. District Court for the District of South Carolina, which said Cromer Food Services Inc. did not have enough detail about the alleged harassment to take any action....
