Allergan, Rivals Debate Competition Claims' Validity

Law360, New York (March 9, 2011, 7:07 PM EST) -- Allergan Inc. tried to convince the Federal Circuit on Wednesday that the court can revive California unfair competition law claims against several rivals whose eyelash growth products allegedly infringe Allergan patents, even though the patent claims are not on appeal.

The district court wrongly ruled that Allergan lacked standing to pursue its claims under California's Unfair Competition Law, Allergan attorney Mark A. Perry of Gibson Dunn & Crutcher LLP told a three-judge panel of the U.S. Court of Appeals for the Federal Circuit.
