Law360, New York (March 08, 2011, 8:09 PM ET) -- A Texas state court on Monday upheld the permits for a coal-fired power plant NRG Energy Inc. is building near Waco, brushing aside protests that state regulators are disregarding federal greenhouse gas and mercury emissions standards.
Judge John K. Dietz of the Travis County District Court rejected the Sierra Club’s administrative appeal of the Texas Commission on Environmental Quality’s broad approval of the NRG Texas Power LLC permits, finding that the commission did not overlook the Clean Air Act’s pollution limits.
