Vista Dodges Bulk Of Ex-Worker's Medicaid FCA Suit

Law360, New York (March 10, 2011, 7:27 PM EST) -- A Texas federal judge Wednesday dismissed most of a False Claims Act suit filed by a woman who said she was fired by Vista Hospice Care Inc. for refusing to cooperate with a Medicaid fraud scheme.

Judge Barbara M.G. Lynn of the U.S. District Court for the Northern District of Texas nixed 11 of 12 claims in plaintiff Misty Wall’s qui tam suit, sustaining only an allegation that Vista provided kickbacks to patients who agreed to stay enrolled in the hospice.
