Asbestos Air Monitor's Conspiracy Acquittal Nixed

Law360, New York (March 14, 2011, 5:49 PM EDT) -- The Second Circuit on Monday vacated a judge's order that acquitted an upstate New York asbestos abatement air quality monitor on a conspiracy count after a jury convicted him of misleading homeowners into thinking their homes were safe.

Mark Desnoyers' conviction for conspiracy to violate the Clean Air Act and commit wire fraud could not be thrown out even if prosecutors failed to provide sufficient evidence to prove one object of that conspiracy, the U.S. Court of Appeals for the Second Circuit ruled.
