Law360, New York (March 14, 2011, 6:05 PM ET) -- The Seventh Circuit reversed a decision Monday in a former employee's breach of contract suit against Elan Motorsports Technologies Corp., allowing him to name an Elan subsidiary — the correct defendant — more than seven years after filing suit.
The U.S. Court of Appeals for the Seventh Circuit remanded the decision to the U.S. District Court for the Southern District of Indiana, where a judge had barred Timothy Wardrop's attempt to name Elan Motorsports Technologies Inc. as a defendant because the statute of limitations had expired....
