Gilead, Roche Sue To Block Generic Tamiflu

Law360, New York (March 15, 2011, 3:30 PM EDT) -- Gilead Sciences Inc. and Roche Holding Ltd. lodged a patent infringement suit Monday in Delaware in an effort to prevent Indian pharmaceutical company Natco Pharma Ltd. from marketing a generic version of the flu drug Tamiflu.

The case, filed in the U.S. District Court for the District of Delaware, alleges that Natco and a subsidiary infringed one of the plaintiffs' patents by submitting an abbreviated new drug application with the U.S. Food and Drug Administration.
