NY Assembly Challenges Cuomo's Malpractice Cap

Law360, New York (March 16, 2011, 2:10 PM ET) -- The New York State Assembly on Tuesday rejected Gov. Andrew Cuomo's proposal to cap noneconomic damages in medical malpractice suits at $250,000, setting up a showdown between the two government branches as final 2011-2012 budget negotiations begin.

New York's Assembly and Senate each passed separate versions of a budget resolution for 2011-2012, accepting and rejecting portions of the executive budget plan unveiled by Cuomo earlier this year.
