Courts Must Draw A Line On Bundling: Briefs

Law360, New York (April 23, 2007, 12:00 AM EDT) -- Courts must look at whether bundled discounts force rivals’ prices to fall below a product’s cost in order to determine if the practice is anticompetitive, advocacy and business groups urge in briefs in a major antitrust appeals case.

Advocacy groups, businesses and law professors were among the interested parties who submitted a total of eight amici briefs, relating their opinions on how the U.S. Court of Appeals for the Ninth Circuit should decide an antitrust case between two hospital systems.
