FAR Council Adopts Interim Sole-Source Contract Rule

Law360, New York (March 17, 2011, 8:33 PM EDT) -- The Federal Acquisition Regulation Council published an interim rule Wednesday requiring a written justification and approval for issuing federal contracts in excess of $20 million to small businesses, despite objections from Native American corporations claiming they would be disproportionately impacted.

The rule specifies that the U.S. Department of Defense, the General Services Administration and NASA must obtain justification and written approval from an appropriate officer before awarding an 8(a) sole-source contract for more than $20 million. The approval must also be made public.
