Fed. Circ. Upholds Agency Firing Over Use Of Funds

Law360, New York (March 17, 2011, 6:56 PM EDT) -- The Federal Circuit has upheld the firing of a Federal Highway Administration contract specialist indicted for allegedly approving $15,000 in unauthorized tuition payments for a colleague.

Plaintiff Vernassa Smith, representing herself in a challenge over her 2009 termination, failed to convince the U.S. Court of Appeals for the Federal Circuit that her punishment was unwarranted or overly harsh.

The unpublished opinion, issued Thursday by a three-judge panel, upheld an earlier decision in which the Merit Systems Protection Board also affirmed Smith's termination. The circuit court said...
