Hostess To Appeal IP Defense Row With Insurer

Law360, New York (March 24, 2011, 1:48 PM EDT) -- Hostess Brands Inc. plans to appeal a Missouri federal judge's decision that its insurer does not have to cover at least $2.5 million in defense costs in an underlying trademark suit with a competitor, an attorney told Law360 on Thursday.

Magistrate Judge Sarah W. Hays of the U.S. District Court for the Western District of Missouri entered a final judgment against Hostess on Wednesday, about a month after she denied the food company's motion for partial summary judgment against Onebeacon Insurance Co. in February.
