11th Circ. Backs Class Cert. In YoPlus Ad Suit

Law360, New York (March 25, 2011, 5:04 PM EDT) -- The Eleventh Circuit on Friday backed class certification in a lawsuit accusing General Mills Inc. of misleading Florida consumers about the digestive benefits of its probiotic yogurt, but suggested a minor modification to the class definition.

The published ruling by the U.S. Court of Appeals for the Eleventh Circuit clarifies Florida's consumer fraud statute and should make it easier to obtain class certification under that law in the future, said Timothy Blood, an attorney at Blood Hurst & O'Reardon LLP who is representing the plaintiffs....
