Pfizer Beats False Marking Claims

Law360, New York (March 28, 2011, 5:02 PM EDT) -- A Tennessee federal judge on Monday dismissed a false patent marking suit against Pfizer Inc., ruling that the complaint failed to meet the pleading requirements established by a Federal Circuit ruling earlier in March.

Judge S. Thomas Anderson of the U.S. District Court for the Western District of Tennessee ruled the complaint merely alleged that Pfizer and its subsidiary Wyeth were sophisticated companies that should have known the patents on the heartburn medication Axid and cattle tapeworm treatment Synanthic were expired.
