9th Circ. Affirms Calif. Shipping Fuel Rules

Law360, New York (March 28, 2011, 8:17 PM EDT) -- The Ninth Circuit on Monday rejected a shipping association's challenge to new, allegedly stringent California fuel use regulations for ships operating up to 24 miles off the state's coast.

A three-judge panel of the U.S. Court of Appeals for the Ninth Circuit affirmed a lower court's denial of summary judgment to the Pacific Merchant Shipping Association in its case against James Goldstene, the executive officer of the California Air Resources Board.
