Law360, New York (March 29, 2011, 3:05 PM ET) -- The Ninth Circuit affirmed a ruling Monday that Zurich Specialties London Ltd. does not have to cover an actuarial firm in litigation over the insolvency of a medical malpractice self-insurance fund in Florida.
A three-judge panel with the U.S. Court of Appeals for the Ninth Circuit sided with Zurich that exclusionary language in its policy with Bickerstaff Whatley Ryan & Burkhalter Inc. frees it from defending or indemnifying the company in a third-party contribution action that accounting firm Spear Safer Harmon & Co.
