Judge OKs Food Fraud Subpoena Against Kuwaiti Co.

Law360, New York (March 29, 2011, 7:21 PM EDT) -- A federal judge in Georgia on Monday denied a magistrate judge’s recommendation to quash a subpoena against a Kuwaiti vendor accused of defrauding the U.S. military out of about $70 million in inflated food costs for American troops.

The U.S. government did not err when it served a criminal indictment related to the alleged food fraud on Agility DGS Holdings Inc., the American subsidiary of Public Warehousing Co. KSC, rather than on the Kuwaiti company itself, according to Monday’s ruling from Judge Thomas W. Thrash Jr....
