Lannett Loses Bid To Enforce Celgene Oral Agreement

Law360, New York (March 29, 2011, 8:18 PM ET) -- A Pennsylvania federal judge on Tuesday shot down Lannett Co. Inc.'s attempt to enforce what it claimed was an oral agreement with Celgene Corp. to settle an antitrust suit over cancer drug Thalomid.

Judge Timothy J. Savage of the U.S. District Court for the Eastern District of Pennsylvania denied Lannett's motion to enforce the purported settlement agreement, finding that an oral agreement reached between Lannett and Celgene during a conference in July 2009 did not qualify as a settlement agreement.
