Texas Bank Loses Bid To Split Up Investors' Fraud Suit

Law360, New York (March 30, 2011, 2:22 PM EDT) -- A Texas federal judge on Tuesday shot down TriCentury Corp.'s bid to sever a suit it faces over its outside general counsel's theft of $2.5 million in investments meant to fund a proposed bank that TriCentury never opened.

Judge Ron Clark denied the defendant's motion in the U.S. District Court for the Eastern District of Texas, finding that the plaintiffs had satisfied the applicable standard for them to join together in bringing the suit and noting that TriCentury had not previously raised its arguments for severance...
