Law360, New York (March 31, 2011, 6:43 PM ET) -- A Nevada federal judge refused Wednesday to dismiss a Sherman Act counterclaim against Bayer AG in the patent infringement suit it is pursuing against Watson Laboratories Inc. and Sandoz Inc. over their efforts to market a generic version of Yaz.
Judge Kent J. Dawson of the U.S. District Court for the District of Nevada said in the order that Sandoz’s counterclaims alleging violations of the Sherman Act would stand.
