9th Circ. Affirms Toss Of CalStar Suits

Law360, New York (March 31, 2011, 8:39 PM EDT) -- The Ninth Circuit backed the dismissal Thursday of suits brought by a California air ambulance rescue provider accusing insurers and employers of underpaying for its services, finding that the cases are not subject to federal jurisdiction.

In a published opinion, a three-judge panel with the U.S. Court of Appeals for the Ninth Circuit said the well-pleaded complaint rule precluded federal jurisdiction over California Shock Trauma Air Rescue's state law claims of quantum meruit, unjust enrichment and open book account against dozens of companies.
