DC Circ. Nixes Verizon, MetroPCS Net Neutrality Suits

Law360, New York (April 4, 2011, 5:28 PM EDT) -- The D.C. Circuit on Monday tossed appeals from Verizon Communications Inc. and MetroPCS Communications Inc. challenging the Federal Communications Commission's new net neutrality rules, saying the filings were premature.

A three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit granted the FCC's motion to dismiss the cases, finding that the challenged rulemaking order was not eligible for judicial review until it has been published in the Federal Register.
