Fed. Circ. Trims Damages In Spent Fuel Contract Suit

Law360, New York (April 7, 2011, 4:19 PM EDT) -- The Federal Circuit on Thursday cut $7 million from a $57 million damages award favoring Energy Northwest in the Washington state-based utility’s suit claiming the U.S. government reneged on a contract to dispose of spent nuclear fuel.

The U.S. Court of Appeals for the Federal Circuit ruled that Energy Northwest wasn’t entitled to a lower court’s $6 million interest award against the government, nor should it receive a $1 million award for modifications it made to handle surplus fuel at a nuclear power plant.
