ASBCA Backs Termination Of $6M Iraq Truck Deal

Law360, New York (April 12, 2011, 1:17 PM EDT) -- The Armed Services Board of Contract Appeals has agreed with the military's decision to back out of a $6.1 million deal for cargo trucks in Iraq, saying the contractor was at fault for failing to deliver the trucks as promised.

The ASBCA issued the ruling on March 22, though it only released its opinion in the last several days. The case pitted the military against Free & Ben Inc., which contracted to provide 126 five-ton cargo trucks from Japan for use by Iraqi soldiers.
