7th Circ. Reverses Remand Of SCI Overtime Action

Law360, New York (April 14, 2011, 8:36 PM EDT) -- The Seventh Circuit said Thursday a party seeking removal under the Class Action Fairness Act need not establish how much plaintiffs could potentially recover, only how much is in question, reversing a decision in favor of Service Corp. International in an overtime class action.

The U.S. Court of Appeals for the Seventh Circuit reversed a decision remanding the suit to state court, finding that a district court had required too much of SCI when the funeral arrangement company sought to maintain federal jurisdiction under CAFA....
