Judge Denies Golf Ball Maker's Request For New Trial

Law360, New York (April 21, 2011, 9:05 PM EDT) -- Callaway Golf Co. failed to score a new trial Thursday after a Delaware federal judge backed a jury's finding that Titleist ProV1 golf ball manufacturer Acushnet Co. had not infringed four patents, entering a final judgment in Acushnet's favor.

Callaway had challenged the March 2010 jury's determination that all four patents were anticipated and obvious, arguing that improper jury instructions and the exclusion of certain evidence and testimony warranted a new trial.
