Superfund Suit Over Sawmill Cleanup Rolls On

Law360, New York (April 22, 2011, 6:49 PM ET) -- A federal judge ruled Friday that a logging company's claims for cleanup costs at a Montana sawmill under the Comprehensive Environmental Response, Compensation and Liability Act were not barred by contract, but dismissed some liability allegations against a paper company.

Adopting a magistrate judge’s recommendations, U.S. District Judge Donald Molloy said a sale agreement when Stimson Lumber Co. bought the sawmill from International Paper Co. did not transfer liability to the plaintiff, barring Stimson’s claims.
