Wyeth Improperly Delayed Generic Effexor: Suit

Law360, New York (May 3, 2011, 6:38 PM EDT) -- Wyeth Inc. was hit with a proposed antitrust class action Friday in Mississippi for allegedly using fraudulently obtained patents and sham litigation to delay generic versions of blockbuster antidepressant Effexor XR.

Pharmaceutical wholesaler Professional Drug Co. Inc. claims that the Pfizer Inc. subsidiary improperly blocked the first generic equivalent of extended-release Effexor from hitting the market until two years after Wyeth’s marketing exclusivity for the original compound patent for Effexor lapsed on June 13, 2008.
