2nd Circ. Rejects Nurses Review Of Class Cert. Denial

Law360, New York (May 3, 2011, 7:56 PM EDT) -- The Second Circuit rejected a request by a group of nurses Tuesday to review the partial denial of their class certification bid in a lawsuit claiming New York hospitals conspired to keep salaries artificially low.

The nurses, who provide direct patient care in hospitals in the Albany-Schenectady-Troy Metropolitan Statistical Area, claim that five hospitals violated antitrust laws by exchanging detailed, nonpublic information concerning nurses’ wages in a bid to suppress their salaries.
