Law360, New York (May 05, 2011, 3:42 PM ET) -- A Washington federal judge on Wednesday declined to toss a Clean Air Act suit in which the U.S. government accused Tesoro Corp. and two subsidiaries of improperly testing their gasoline for aromatics, olefins and other properties.
The decision from U.S. District Judge James E. Boasberg dealt with only one aspect of Tesoro's motion to dismiss, which essentially accused the government of double counting.
