9th Circ. Won't Revive EBay Sellers' Antitrust Suit

Law360, New York (May 10, 2011, 1:46 PM ET) -- The Ninth Circuit refused on Monday to revive a putative class action brought by a group of eBay Inc. sellers accusing the company of monopolizing the online auction market and charging excessive fees.

In an unsigned, unpublished decision, a three-judge panel of the Ninth Circuit rejected the plaintiffs’ arguments that the lower court erroneously concluded the online sellers failed to show that eBay's alleged antitrust violations harmed them.
