Law360, New York (May 12, 2011, 3:50 PM ET) -- A California federal judge on Tuesday refused to send back to state court a putative class action against Hewlett Packard Co., Costco Wholesale Corp. and others over a portable hard drive that allegedly doesn't operate as advertised.
U.S. District Judge Larry Allen Burns found that his court had original jurisdiction over the case because the amount at issue exceeded $5 million, additionally ruling that a local controversy exception in the Class Action Fairness Act that would bar federal jurisdiction didn't apply.
