Executive Risk Must Cover Hospital Privacy Row: Judge

Law360, New York (May 12, 2011, 6:33 PM EDT) -- A federal judge ruled Thursday that Executive Risk Indemnity Inc. must provide coverage for most of an $11.5 million payout that the largest hospital system in West Virginia made to settle an underlying defamation and invasion of privacy suit.

Executive Risk, which sold directors, officers and trustees liability insurance to the 838-bed nonprofit Charleston Area Medical Center, argued that at least some portion of the settlement fell under a dishonest and fraudulent acts exclusion.
