Microsoft, Others Bring App Store IP Battle To EU

Law360, New York (May 12, 2011, 7:19 PM EDT) -- Microsoft Corp., HTC Corp., Nokia Corp. and Sony Ericsson Mobile Communications AB asked the European Union's trademark office Thursday to invalidate Apple Inc.'s App Store trademarks, taking the battle over the online shop's name to a second continent.

In a joint application to the EU's Office for Harmonization of the Internal Market, Microsoft, HTC and Sony Ericsson argued Apple's marks were not distinctive enough to warrant intellectual property protection, saying the name was nothing more than the combination of two generic, descriptive words.
