Law360, Washington (May 16, 2011, 2:06 PM ET) -- The U.S. Supreme Court on Monday declined to hear Taiwan-based Princo Corp.'s appeal of a failed suit accusing Philips Corp. and Sony Corp. of conspiring to suppress alternative technology development for making recordable CDs.
Princo filed a petition for writ of certiorari in January, urging the high court to consider whether the equitable doctrine of patent misuse should remain a flexible doctrine to be applied when a patent holder has wrongly tried to extend a patent's scope.
